Terms of Service

Plain-English operating terms. These terms are written and maintained by Arvocado’s operator, not by a law firm. By using Arvocado you agree to the version published here at the time of your visit. They are provided as information, not legal advice. If you need a legal opinion on how a law applies to your circumstances, consult a qualified Australian solicitor.

1. Who we are

Arvocado (“Arvocado”, “we”, “us”) is a property discovery app for Australian buyers and renters, operated by Aapo Foundation Pty Ltd from Melbourne, Australia. Contact: hello@arvocado.com.au.

2. What Arvocado is — and what it isn't

Arvocado surfaces listings from real estate agents, a personality-match quiz, saved-listing alerts, a map view, a mortgage calculator, an affordability planner, and a few other discovery tools.

Arvocado is a general information and discovery service. It is not:

  • A real estate agent, agency, or representative. We do not sell, lease, or manage properties.
  • Professional financial, legal, tax, planning, valuation, or investment advice.
  • A substitute for engagement with a qualified real estate agent, solicitor, conveyancer, broker, building inspector, or valuer.
  • A guarantee that any listing, photo, price, inspection time, or agent detail is current or accurate.

Decisions about specific properties, transactions, or mortgages must be made with your own professional advisers.

3. Listing accuracy — important

Listings on Arvocado are provided by the agents who list them, not by us. We make reasonable effort to display them correctly, but we do not independently verify:

  • Prices, price guides, or auction outcomes.
  • Inspection times or whether they will run as scheduled.
  • Property dimensions, bedroom counts, land size, or zoning.
  • Photo accuracy or whether photos represent the current state of the property.
  • Whether a property is still available, under offer, or already sold or leased.

Always verify with the listing agent and inspect in person before making an offer. Agents remain bound by the Estate Agents Act 1980 (Vic) and equivalent state real estate legislation for the accuracy of their listings and representations.

4. Calculators and affordability tools

The mortgage calculator, stamp duty estimates, LMI estimates, and affordability planner on Arvocado are indicative only. They use generic assumptions (representative interest rates, state-level stamp duty tables, HEM-style living cost floors, APRA serviceability buffers) and may not reflect your specific circumstances. Talk to a licensed mortgage broker, conveyancer, and solicitor before committing.

5. Your account

  • You must be 18 or older to create an account.
  • You’re responsible for keeping your email secure — our sign-in is password-less, so anyone with access to your inbox can sign in as you.
  • One human, one account. Don’t create accounts for someone else.
  • You can close your account any time by emailing hello@arvocado.com.au.
  • We may suspend or terminate accounts that break these terms, scrape content, spam the enquiry form, or create legal, security, or operational risk.

6. Acceptable use

You agree not to:

  • Use Arvocado to break any law, infringe a third-party right, or mislead anyone.
  • Send enquiries that aren’t genuine property interest (spam, phishing, recruitment pitches, scraping for contact details).
  • Scrape, mirror, or resell listings or derived data at scale.
  • Interfere with the service, bypass rate limits, or access areas you haven’t been authorised to access.
  • Upload content you don’t have rights to.
  • Use automated tooling beyond what a normal browser does.

7. Your content

When you save a note on a listing, tag a listing, take the personality quiz, send an enquiry, or accept a compatibility pair invite, you keep ownership of what you wrote. You grant us the permission we need to store it and display it back to you (and, for enquiries and pair invites, to the intended recipient).

8. Agent content and licensing

Agents retain ownership of their listing copy and photos. By pushing a listing to Arvocado, agents grant us a non-exclusive licence to display that listing. Agents warrant to us that they hold the rights necessary to publish the listing and remain responsible for accuracy and compliance with applicable real estate regulation, including the Estate Agents Act 1980 (Vic) and equivalent state legislation (e.g. the Property and Stock Agents Act 2002 (NSW), Property Occupations Act 2014 (Qld)).

9. Donations and subscriptions

Arvocado is free for buyers and renters. Optional donations are processed by Stripe. Two donation modes:

  • One-off — customer chooses amount, charged once.
  • Monthly support — recurring subscription at a preset tier. You can pause or cancel any time from the Stripe customer portal we link from /support.

Donations are not tax-deductible (Aapo Foundation Pty Ltd is not a registered DGR). No refunds on voluntary donations unless required by law. Recurring subscriptions continue until you cancel; cancellation stops future charges but does not refund past charges.

10. Third-party services

Arvocado depends on Stripe (payments), Supabase (database + auth), Resend (email), Vercel (hosting), MapTiler (maps), and the open OpenStreetMap project (geocoding + amenities). Your use of features that depend on these services is also subject to their terms.

11. Availability

We aim to keep Arvocado up and working, but we don’t guarantee uptime, availability, or feature continuity. Features may change or be removed. For material changes (account deletions, data migrations) affecting signed-in users, we’ll give reasonable notice by email.

12. Warranties and liability

To the maximum extent permitted by law, Arvocado is provided “as is” and without warranty of any kind. We do not warrant that the service will be uninterrupted, error-free, or that any listing, calculator output, or suburb insight is accurate, current, or fit for any particular purpose.

Nothing in these terms excludes any consumer guarantee under the Australian Consumer Law that cannot be excluded. Where a right cannot be excluded, our liability is limited (at our option) to re-supplying the service or refunding the price paid for the specific paid service affected.

Subject to the above, we are not liable for any indirect, consequential, or special loss — including loss of profits, loss of investment opportunity, loss arising from property purchase decisions, missed inspections, or reliance on calculator outputs, listing data, or suburb insights.

13. Termination

You can stop using Arvocado at any time and close your account per Section 5. We may suspend or terminate access for material breach of these terms, or where continued access creates a legal, security, or operational risk.

14. Governing law

These terms are governed by the laws of Victoria, Australia. Disputes are subject to the non-exclusive jurisdiction of the courts of Victoria.

15. Changes to these terms

We may update these terms from time to time. Material changes will be flagged on this page and, for signed-in users, notified by email. Continued use after an update constitutes acceptance of the revised terms.
